Liability Release and Waiver
I, the parent/guardian (the “Parent”) of the listed player (the “Participating Child”), a minor, agree that I and the the Participating Child will abide by the Gleannloch Farms Athletic Complex Usage and Rental Guidelines. Recognizing the possibility of physical injury associated with sports and in consideration for Gleannloch Farms Community Association allowing the Participating Child access to and use of the sports fields and facilities located within the Gleannloch Farms community, I HEREBY RELEASE, DISCHARGE and/or INDEMNIFY Gleannloch Farms Community Association, its directors, officers, committee members, agents, managers, successors, assigns, affiliated organizations and sponsors, their employees and associated personnel (collectively the “Association”), including the owners of fields and facilities utilized for sports activities against any claim by or on behalf of the the Participating Child as a result of the Participating Child’s participation in the activity, and/or being transported to or from the same, which transportation I hereby authorize.
I, the Parent, represent that I have rights of custody with respect to the Participating Child that permit me to enroll the Participating Child in the activity described above, without the permission of any other parent or guardian or other person possessing custodial rights with respect to the player; I further represent that I have obtained the consent of each other person who possesses custodial rights with respect to the Participating Child to enroll the Participating Child in the above-described program. I am familiar with the facilities, premises, and equipment of the Gleannloch Farms sports fields and facilities and I have inspected said facilities, premises, and equipment, and find them safe and reasonably suited for the purposes for which they are to be used.
parent, acting on behalf of the Participating Child, hereby assumes full responsibility for and risk of bodily injury, death, or property damage caused or sustained by the Participating Child, Parent, Participating Child’s or Parent’s invitees or licensees due to any act or omission of the Association while the Participating Child, Parent, Participating Child’s or Parent’s invitees or licensees are in, about, or upon the premises of the gleannloch farms sports fields and facilities, or while they are using any of the Association’s facilities, premises, or equipment or are participating in any activities described in this release and waiver whether or not caused by the sole, joint, comparative, or contributory negligence of the Association.
PARENT HEREBY ACKNOWLEDGES THAT PARENT HAS READ THIS RELEASE AND WAIVER AND UNDERSTANDS THE TERMS HEREOF. Parent represents that Parent is at least eighteen years of age, fully competent and has signed this Release and Waiver voluntarily. Parent acknowledges that by signing this Release and Waiver, Parent is waiving certain rights, including any and all rights Parent and Participating Child may have against the Association. Parent acknowledges and represents that all statements contained in this Release and Waiver are true, and Parent is voluntarily signing this Release and Waiver. Parent further agrees that no oral representations, statements or other inducements, apart from the foregoing, have been made to the Parent or Participating Child.
